MINUTES OF JULY 16, 2007 MEETING

The meeting convened at 6:00 p.m.
PUBLIC INPUT:
Vince Iacopino presented some photos of his property showing damage from a nearby ditch. He said that there is an old culvert that is plugged and is draining water onto his property. Wright said the Board will look into this problem and evaluate.
Peter Metsch from Newbury News approached the Board to discuss the size and placement of an outdoor sign for his new store. He presented some photos of his proposed sign. He would like to put up a 2 x3 3 dimensional sign on the outside of the already existing larger sign. Wright said signs must all be inside of the bigger sign. The overall size of the sign must not exceed 72 square feet for signs by the road, and not to exceed 15 square feet on the building. Powell told Metsch to measure the sign to determine the true size. He also requested that Metsch bring in photos of the old sign.
APPOINTMENTS:
Chief Robert Lee was present for a public hearing in which was discussed revisions and additions to town ordinances. He explained that he is trying to review and update these to make them more uniform. He has divided the ordinances into 5 categories: traffic, animals, alarms, fireworks and noise. Bob said all traffic laws have been consolidated with the name, purpose, definitions, restrictions and penalties. He said that he cannot enforce any speed limits under 25 mph unless it is a hospital or school zone. He would like to change the alarm ordinances so that there will be a charge for multiple false alarms. The changes to the animal ordinances include paying fines if a dog runs at large, or if is a nuisance, menace or is
vicious. Fireworks have been now described as any flammable object that shoots up at least 5 feet and explodes. All fireworks must get permission from the fire chief. The times proposed for the noise ordinances were 10:00 p.m. – 7:00 a.m., Sunday – Saturday and 10:00 p.m. – 10:00 a.m. Saturday night. Times in which the Highway Department gets started in the morning would be the exception. Other exceptions will be snow removal and emergency vehicles. Chief Lee said that these are all in draft form. He then opened up the floor to any questions. Kara Obey asked if any roads will be changed from 2 way streets to 1 way
streets. The Chief said no. Chief Lee was also asked if copies of these ordinances would be available for the public to look at. He said he would put a copy in the town office and the police station. Wayne Seaholm said he would like to see the times of the excessive noise change to 9:00 p.m. during the week. Tanya Hathaway said that the 10:00 a. m. time on Sunday seemed rather late. Mary Bachelder asked if dogs will be allowed by the beach. The Chief said in the parking lot, but not on the sand or the grass. Seaholm said that the sole responsibility of the false alarms of the security systems lies with the property owner. Wright inquired about the jurisdiction for noise control on lakes. He said the noise of snowmobiles and boats is well past the 10:00 p.m. hour
and should be regulated. Lee will look into the jurisdiction of noise occurring on the water.
Cal Prussman presented the Board with estimates of repairs to Winding Brook Road, Rollins Road and Bartlett Road. He will start work on Winding Brook and Rollins Road now and will plan to work on Province Road the first week of August. It was decided that dust maintenance would take place near the beach at Sunapee Hills.
REGULAR BUSINESS:
PAYROLL & ACCOUNTS PAYABLE: Week ending July 14, 2007 approved.
MINUTES: Minutesof July 2, 2007 approved to file.
ABATEMENTS/REUNDS/EXEMPTIONS: The Board approved 7 tax abatements.
OLD BUSINESS:
Wright gave anupdate on the Fishersfield project. He reported that excavating for the
building has taken lace and they are ready to pour concrete. They are putting down the base
for the parking lot.
NEW BUSINESS:
Pavlicek presented a Quitclaim deed for Fairly Stable, LLC that the Select Board signed.
Pavlicek reported that the Lake Sunapee Snowmobile Club would like to hold their annual fundraising spaghetti dinner at the safety services building and have a raffle on August 4. This was approved.
Powell said he would like to set some guidelines for the Newbury Update. It was agreed upon that no advertising would be allowed in the publication. The sole purpose of the newsletter will be to recap official town Board meetings.
There was a general review of this year’s Old Home Day. Wright said that he would like to see two serving lines next year. He mentioned the possibility of selling t-shirts next year. Wright also mentioned that he would like to go forward in looking into getting the “Forever Locked” exhibit for next year’s celebration. He would also like Fish & Game to do a presentation next year. Wright will work on these projects for the 2008 Old Home Day. It was suggested that more sides should be available for the dinner. Pavlicek said that he will schedule a recap meeting to discuss recommendations for next year’s event with the Old Home Day committee. Powell said that he would like to thank everyone who
took part in Old Home Day. He said that everyone really came together to make this a fun filled day in Newbury.
Pavlicek will put out a notice requesting bids to take down the barn at the Camacho property.
Pavlicek stated that Elizabeth Ashworth has offered her help in consulting for recycling for the transfer station.
NON-PUBLIC SESSION:
The Board voted to go into non-public session under RSA 91-A:3, II, a-e at 6:00 p.m. to discuss a personnel issue. Agreement was reached. The Board came out of non-public session at 6:30 p.m.
