Members Present: Katheryn Holmes, Chair; Eric Unger, Vice-Chair; Bob Stewart, Member; Russ smith, Ex-Officio Member.

Ms. Holmes called the meeting to order at 7:04 p.m.

ADMINISTRATIVE

Minutes

Review of the minutes of March 21, 2017 was tabled until the next NCC meeting.

Commissioner Retirement

Ms. Holmes informed the NCC that Bill Annable, NCC Alternate, has decided to retire from active involvement in the NCC. She and the Commissioners expressed their appreciation of Mr. Annable’s years of dedicated work on behalf of the Newbury Conservation Commission and noted that his wisdom and presence on the commission will be missed.

INTENT TO CUT

Mr. Unger expressed concern regarding enforcement of town regulations when tree cutting occurs near a protected buffer zone.

Mr. Stewart expressed concern that Newbury currently does not have restoration regulations that may be implemented when needed. He noted that, since Newbury’s shoreland regulations are stricter than state shoreland regulations, when the state comes in to enforce shoreland regs, the less stringent regulations will be enforced, not Newbury’s shoreland requirements. Mr. Smith stated that the Planning Board will look at developing possible amendments to address this concern.

Commissioners reviewed the following Intents to Cut:

Kevin Daniel on Gillingham Drive, Tax Map/Lot # 49-424-187 for 20,000 feet of white pine, 4,000 feet of hemlock, 1,000 feet of red pine, 2,000 feet of spruce & fir, 5,000 feet of hard maple, 1,000 feet of birch, 1,000 feet of yellow birch, 15,000 feet of oak, and 4,000 feet of beech & soft maple.

Rick Deschenes on Newell Road, Tax Map/Lot # 036-523-439 & 036-523-100 for 2,000 feet of white pine, 3,000 feet of hemlock, 1,000 feet of spruce & fir, 1,000 feet of yellow birch, 5,000 feet of oak, 1,000 feet of ash, and 2,000 feet of beech & soft maple.

 Kenneth & Diane Brown/Loch Lyndon Family Comp. Trust on Gillingham Drive, Tax Map/Lot # 049-061-117 & 049-273-009 for 30,000 feet of white pine, 10,000 feet of hemlock, 1,000 feet of red pine, 1,000 feet of spruce & fir, 5,000 feet of hard maple, 1,000 feet of birch, 1,000 feet of yellow birch, 10,000 feet of oak, and 7,000 feet of beech & soft maple.

Carleen Mackay on Village Road, Tax Map/Lot # 043-632-424 for 20,000 feet of white pine, 10,000 feet of hemlock, and 7,000 feet of oak.

D&E Land Holding LLC/R. Garth DuBois & Carol Edmunds on Village Road, Tax Map/Lot # 44-316-433 for 7,500 feet of white pine.

Donald Clifford on Mountain Road, Tax Map/Lot # 024-778-109 for 50,000 feet of hard maple, 20,000 feet of yellow birch, 5,000 feet of oak, 25,000 feet of ash, and 10,000 feet of beech & soft maple.

Scott & Shannon Macmichael on Baker Hill & Route 103A, Tax Map/Lot # 27-730-231 for 8,000 feet of white pine, 8,000 feet of hemlock, 4,000 feet of beech & soft maple. Ms. Holmes noted that the Macmichael’s had a “cease and desist” order in place

BUFFER ZONE CUT

Ms. Holmes reported that there is one Buffer Zone Cut application in play on the Holcomb property on Great Island but it has not proceeded due to adverse weather conditions.

Ms. Holmes noted that all persons submitting tree cutting applications will be sent a letter from the Land Use Coordinator containing comments regarding the application submitted by the NCC, the Selectboard and the Code Enforcement Officer.

WETLANDS/SHORELANDS

Ms. Holmes noted that NCC letters were sent to the following regarding approved permits:

Ronald Ferris for Shoreland Impact Permit 2017-00758

Dean Lebaron Trust for Wetlands & Non-Site Specific Permit 2017-00747

Anthony/Margit Buonicore for Shoreland Impact Permit 2017-00629

Ms. Holmes reviewed the following communications from the NH Department of Environmental Services (DES):

Permit by Notification (PBN)

For Mark/Tracy Wood, 11 Bay Point Road, Tax Map/Lot # 7A-077-470.

Frazier Ave. Camp Property Trust, 9 Frazier Avenue, Tax Map/Lot # 20-327-448.

 

Standard Dredge & Fill Application

For HGD III Trust, 11 Fells Cove Road, Tax Map Lot # 017-231.

For Waxman Personal Residence, 206 Bowles Road, Tax Map/Lot #016-058.

 

COMMUNICATIONS

Ms. Holmes shared with the NCC the following:

Letter to the Planning Board from the NCC regarding the Bob’s Beacon Marina parking lot plan.

Request to the Planning Board regarding the Willow Pond Gravel Pit pertaining to the amount of time allowed for a site visit and review of the Willow Pond application. There was further discussion about the Willow Pond Gravel Pit and its operations moving forward. Mr. Smith said the Selectboard intends to monitor the operation in the upcoming years.

Letter from the DES regarding testing water samples for chemicals. Mr. Stewart noted that the sampling field has been expanded because of NH’s old water systems and the aging public water systems throughout the state. However, he added, there is not that problem in Newbury.

LSPA 2016 Annual Report

The Warner River Watershed Conservation Project. Ms. Holmes noted how effective this group is regarding community outreach. She added that they are sponsoring Flood Resiliency workshops on June 14, 2017 and June 28, 2017 and invited all interested Commissioners to attend.

NH Lakes Congress on June 1st and 2nd. Ms. Holmes reviewed the conference’s highlights and invited interest Commissioners to attend.

 

Mr. Unger made a motion to adjourn the meeting. Mr. Smith seconded the motion. All in favor.
