Members Present: Katheryn Holmes, Chair; Alden Beauchemin, Bob Stewart; Members.

 

Ms. Holmes called the meeting to order at 7:14 p.m.

 

ADMINISTRATIVE:

 

Mr. Stewart gave an update on licensing and what happened with the finance committee with the proposed changes by Governor Sununu, including the repeal of licensed/certified wetland scientists. He said they will keep watching it for now.

 

Ms. Holmes read the following letter that was written in opposition to HB 2 and HB 655:

Dear NHACC,

Newbury Conservation Commission Newbury, New Hampshire

Newbury Conservation Commission (NCC) is joining New Hampshire As- sociation of Conservation Commissions (NHACC) in opposition to HB2 and HB655. We are shocked that the state/Governor would want to appeal many of NH licensing laws regarding Wetland & Soil Scientist and Foresters. The NH Board of Natural Scientist must continue their rigorous program for professional standards. We have valuable state regulations & rules that protect our critical environmental areas in New Hampshire. These professionals help our citizens to be in compliance with our regula- tions and help educated them to use “Best Practices” to preserve our wet- lands and waters. We must not be pushed back into the 19th Century! This is a situation like throwing the baby out with the bath water!

Please, if you must, make improvements but do not revoke or repeal the license requirements that are put forth in the HB2 proposal statements be- low. We are totally concerned for the state’s environmental welfare that is protected by Wetland – Soil Scientist and Foresters. We urge all to recon- sider the Governor’s proposal! When our wetlands are contaminated tourism is over. Keep our high standards!

Line 453 of the bill revokes the license requirements for Natural Scien- tists by repealing
RSA 310-A:75 through 310-A:96, relative to the regulation of natural scientists.

Line 367 of the bill repeals the licenses requirement for Foresters.

Minutes

The Commission reviewed the minutes of February 22, 2023. Mr. Stewart made a motion to accept the minutes as written. Mr. Beauchemin seconded the motion. All were in favor.

TREE APPLICATIONS IN PROTECTED SHORELAND  - 1

DES

  • Shoreland Dredge and Fill Application – Melissa Rusinski 358 Bowles Road – Install a H shaped seasonal dock 6’ x 47’ main pier and a 6’ x 26’ pier connected by a 6’ x 10’ walkway. Lastly install two seasonal boatlifts and two seasonal PWC lifts adjacent to the dock. Under technical review.
  • DES Letter 358 Bowles Road – File #2023-00412 to Town & NCC
  • Shoreland Impact Permit-2023-00048 – Van Siclen – 28 Echo Cove Road. – Impact 4,803 sq. ft. of protected shoreland in order to construct an attached garage addition to the primary structure, stormwater management, a detached garage, and an addition to the driveway with a parking area, conversion of a portion of the driveway to pervious pavers, relocation of the septic tank. – Request for more information.
  • PBN Application 17 Bay Point Landing – Jeffrey Eiras replace existing crib agent: Rick Green. NCC had site review & signed.
  • Shoreland PBN Application – Lyda &  Steve Garrant Pine Cliff Road – Propose to temporary impact 1210 sq. ft. for regarding, steps and add 251 sq. ft. of new impervious for the construction of a retaining wall and patio area. Total impact of 1,411sq. ft.
  • Request for More Information Letter #2023-00192 Denise & Lawrence Masse 48 Alsubet Court.

 

APPOINTMENTS Chris Kessler – Gradient, PLLC -Presentation for 110 Rt. 103A (Worrall/Bakron – owns)  to develop a new landscape, septic, stormwater management and planting restoration plan. 75% of the boathouse is over the water. The yard is a square shape. It was first designed by another architect, and it has a shoreland plan and they will need to go for an amended shoreland plan. Mr. Kessler showed where the septic tank and field are located. They are trying to work on stormwater management and a retaining wall just off the shoreland that is separating. And finally, the septic tank needs to be replaced and moved. He explained they are hoping to get the tank behind the 50’ but not the 75 ‘ setback. This would save 4 – 6 feet of cover.

 

Mr. Stewart said it looks like they are doing everything right. Ms. Holmes said a five-year implementation plan for restoration should be included in the plans.

 

Ms. Holmes thanked them for coming in. They will move on to the Zoning Board next.

  • Ms. Holmes sent out a copy of the Flash on the Beacon and Save Lake Sunapee watershed email.
