Board Members Present:  Darren Finneral, Chair; Chris Hernick, Vice-Chair; Jim Lord, Chris Millette, Denise Mitchell, Wayne Seaholm, Members, Kristen Shultz, Alternate; Peter Stanley, Consultant.

 

Mr. Finneral called the meeting to order at 7:05 p.m.

 

ADMINISTRATIVE:

 

Minutes:

 

The Board reviewed the minutes of May 17, 2022. Corrections were made.

 

Mr. Millette made a motion to accept the minutes with proposed corrections.  Mr. Lord seconded the motion. All were in favor.

 

 

Public Hearings:

 

7:10 p.m. – Continuance - Case 2022-006 – Request for Revocation of Site Plan Review – JPC Investments, LLC (owner), for property located at 1066 Route 103, Newbury, NH019-384-537.

 

Mr. Finneral said there is an application for a minor site plan review.

 

The representative said they came in with a plan in 2019 and some of the paperwork was not filed when he originally filed it. The new Code Enforcement Officer called them because they changed the use to a two-bedroom apartment rather from a one-bedroom apartment and an office. The Code Enforcement Officer issued a Notice of Violation on April 21, 2022. It is no longer a business; it is just a residential rental property at this point. Mr. Hernick asked if this is stemming from a septic issue. Ms. Mitchell said that she thinks it is fine, but if they want to switch back to an office, he will need to come back to the Planning Board for permission. Mr. Stanley agreed to approve the change of use and does not need a site plan application for the second bedroom. 

 

Mr. Hernick made a motion to approve the minor site plan to eliminate the office space and have it go back to an entirely residential property subject to revisiting again if the applicant wants to change the use in the future.  Mr. Millette seconded the motion. All were in favor.

 

7:20 p.m. – Case 2022-008 – Final Minor Site Plan Review – The Fells (owner), David Bashaw (agent), for property located at 456 Route 103A, Newbury, NH Tax/Map 018-232-347proposing to relocate and enlarge the welcome kiosk.

 

Mr. Finneral checked the application for completeness. He found the application complete.

 

Mr. Bashaw said this is for a welcome kiosk at The Fells. He shared that they would like to move the kiosk about 50’ from where it currently it is. They were originally going to build it themselves, but Lumber Barn had one that served their purposes, so it is a little larger than the original structure. Mr. Finneral asked if they are losing any parking spaces and Mr. Bashaw thinks they are only losing one parking space. Mr. Lord asked if there will be any safety bumpers, so no one bumps into it. Mr. Bashaw said they might put in planters that will create a border.

 

Mr. Seaholm made a motion to approve the Minor Site Plan Review for the relocation for the kiosk. Mr. Millette seconded. All were in favor.

 

Other Business:

 

Working Session #1 date – It was decided to hold the Joint Board Meeting prior to the work session. It was decided that the Joint Board Meeting will take place on Thursday, July 21, 2022, at  6:30 p.m.

 

Mr. Finneral asked the Board members if they wanted to see the ZBA minutes. Ms. Favreau said they are published on the GIS. Ms. Mitchell said some things are broken on the GIS and Ms. Favreau said they are working on that.

 

Mr. Lord made a motion to adjourn. Mr. Hernick seconded the motion. All in favor.

The meeting adjourned at 8:12 p.m.
