Board Members Present:  Darren Finneral, Chair; Chris Hernick, Vice-Chair; Jim Lord, Chris Millette, Denise Mitchell, Wayne Seaholm, Members; Scott Wheeler, ex-officio.

 

Mr. Finneral called the meeting to order at 7:02 p.m.

 

ADMINISTRATIVE:

 

Minutes:

 

The Board reviewed the minutes of November 15, 2022. Corrections were made.

 

Mr. Fineral made a motion to accept the minutes with proposed corrections.  Mr. Seaholm seconded the motion. All were in favor.

 

Sign Case 2022-012 DLK Trust & Fingeroth Trust Annexation Mylar – Signed by Board members.

 

Review Case 2022-003-DeRoche-Final Minor Subdivision that conditions set precedent have been met

 

- There is no DES subdivision approval needed for the big lot. State subdivision approval is only needed on any lot 5 acres in size or smaller that will have on-site septic and on-site water supply. The Board decided that no approval is needed for lot #2.

 

- Another condition set precedent states: “Easement to be issued on the larger lot (67 acres) so the larger lot can continue to use the driveway through the small lot.” The larger lot utilizes a separate driveway off of South Road and not over the small lot. In addition, as of right now, both lots are owned by the same owner (Marion B. DeRoche) so the grantor and grantee of the easement would be the same person. The Board decided that this condition is no longer needed.

 

- The third condition set precedent on the notice of decision, the Board reviewed the Easement Deed and decided the condition has been met.

 

Mr. Hernick motioned to take away the need for approval for lot #2 in the condition set precedent #1. Mr. Millette seconded the motion. All were in favor.

 

Mr. Lord motioned that the condition has been met for the Easement Deed. Mr. Seaholm seconded the motion. All were in favor.

 

Mr. Mr. Finneral motioned that the condition set precedent #2 is no longer needed. Mr. Lord seconded the motion. All were in favor.

 

Other:

 

The public hearing is scheduled for Thursday, January 5 at 7:00 p.m.

 

Mr. Finneral said Article 12 under the Cluster Development if it is under 100 people, they need to be notified individually.

 

The case from last month regarding the Trow property will need to be revisit this case. Mr. Finneral said he would like to have the town attorney at the meeting with us.

 

Mr. Millette made a motion to adjourn. Mr. Wheeler seconded the motion. All in favor.

The meeting adjourned at 8:18 p.m.
